Terms of Use

By downloading or using the Carto app, you agree to these Terms of Use in their entirety. If you do not agree, please do not use the app.

1. About these Terms

These Terms of Use ("Terms") govern your access to and use of the Carto mobile application ("App"), available on Apple's App Store.

The App is published by Jolly Home ("Publisher"), reachable at: contact@jollyhome.org.

2. Description of the Service

Carto is a grocery list management app for iPhone. Its features include:

  • creating and organizing lists of items;
  • a dedicated shopping mode for managing purchases in real time;
  • syncing lists with other household members via iCloud (Apple Inc.).

The App is available as a free download. Certain advanced features may require a paid subscription purchased through the App Store.

3. Eligibility

Use of the App is limited to individuals who have the legal capacity to enter into a binding agreement. Minors must have the prior consent of their legal guardian.

The App requires a compatible iOS device and an internet connection for sync features.

4. User Account

The App may offer sign-in via "Sign in with Apple." The Publisher does not have access to your Apple credentials. Account-related information is handled in accordance with Apple's privacy policy and the App's Privacy Policy.

You are responsible for maintaining the confidentiality of your account access and all activity that occurs under it.

5. License

The Publisher grants you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, in compliance with these Terms and the App Store terms.

This license does not grant you any rights to the source code, algorithms, or underlying components of the App.

6. Prohibited Conduct

You agree not to:

  • use the App for any unlawful purpose;
  • attempt to decompile, reverse-engineer, or disassemble the App;
  • circumvent any security or access control measures;
  • use the App in a way that may damage or impair the Publisher's systems.

7. User Content

Data you enter into the App (lists, items, etc.) belongs to you. The Publisher makes no claim of ownership over this content.

Sync data is stored in your personal iCloud space via Apple's CloudKit service. The Publisher does not have access to your synced data without your explicit consent.

8. Intellectual Property

The App, its design, interface, features, text, icons, and all components are the exclusive property of the Publisher and are protected by applicable intellectual property laws.

Any unauthorized reproduction, representation, modification, or exploitation is prohibited.

9. Availability and Changes to the Service

The Publisher strives to maintain App availability but cannot guarantee uninterrupted access. Maintenance, updates, or events beyond the Publisher's control may cause temporary interruptions.

The Publisher reserves the right to modify, suspend, or discontinue any part of the App at any time, with or without notice.

10. In-App Purchases and Subscriptions

Any in-app purchases or subscriptions are managed exclusively by Apple through the App Store, in accordance with Apple's terms and conditions. The Publisher has no access to your payment information.

Subscriptions renew automatically unless cancelled before the end of the current period, as governed by App Store rules.

Refunds for App Store purchases must be requested directly through Apple, not the Publisher.

11. Disclaimer and Limitation of Liability

The App is provided "as is." The Publisher shall not be liable for:

  • loss of data resulting from user error or hardware failure;
  • service interruptions caused by third parties (Apple, network carriers, etc.);
  • inaccuracies in user-entered information.

To the maximum extent permitted by applicable law, the Publisher's total liability shall not exceed the amounts, if any, paid by you for subscriptions in the preceding twelve months.

12. Termination

You may stop using the App at any time by uninstalling it. Uninstalling the App results in the loss of any local data not synced to iCloud.

The Publisher may suspend or terminate your access if you breach these Terms.

13. Changes to these Terms

The Publisher reserves the right to modify these Terms at any time. Changes take effect upon publication on this site. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by French law. In the event of a dispute, the parties shall first seek an amicable resolution. Failing that, the competent courts in the Publisher's jurisdiction shall have exclusive jurisdiction.
